As we've shared before, the Mequon Common Council was planning to take up the issue of rezoning property and altering an open space easement to facilitate development of a 19-lot subdivision south of Freistadt Road along the Milwaukee River tomorrow, Tuesday March 13th.

Due to pressure from concerned citizens like you, the matter has been pulled from this week's agenda. Milwaukee Riverkeeper does not believe that the issue is dead; however, we suspect the rezoning request will head back to Mequon's Planning Commission for further review, and resurface again before the Common Council in April.

The open space easement is listed in the titles of property in the Deer Trail Estates subdivision to the north of Friestadt Road and 18 separate actions by the City in the past have established this land was to be permanently protected as open space. The property owners are adamant that the entire 43-acre site is to remain open and undeveloped, according to the agreement between the City and the original developer of the Ville du Parc parcel.

Milwaukee Riverkeeper believes the open space easement is binding, and that allowing for development of housing at this site would set a dangerous precedent for other protected open space areas throughout Mequon. This site is also critical to the protection of water quality and wildlife habitat, and prevention of flooding in the area. Over 75% of this area is designated as floodway and adjacent lands are hydrologically connected to the river. Furthermore, neighboring home owners in Deer Trail Estates have experienced major problems with groundwater infiltrating into their basements due to sandy soils and high water table; thus, developing any homes on this property would be problematic.
